I have an application before a town for site plan approval. The applicant (my client) has owned the property for 75 years. The town attorney wants to know how the street my clients' land fronts on became a public road. There is about 3000 car passes per day. The physical road is at least 75 years old. My deed goes to the sideline of the road. The tax map shows a public road. How do you deal with these situations? Is it the applicants burden to prove they are located on a public road?
