No one wants to be on the wrong end of a lawsuit. But every professional is at risk. "You would have to be an inanimate object to be immune from prosecution," says Jeff Lucas, JD, PS. "Everyone owes a duty to everyone else to 'do no harm.' When your actions do harm to someone else--either physically or simply harm to property and the associated rights--you have committed a tort that is punishable through a civil action."
One of the most common torts charged against the professional service provider is the tort of negligence, according to Lucas. But many other torts can also be committed in the process of simply staking a client's deed. While professional liability insurance offers some protection against legal action, many situations can be avoided altogether by ensuring that all business practices follow the laws that affect professional service providers.
